Terms of Service

1. Acceptance of Terms

By accessing or using the Powwow Pin website, mobile features, APIs, or any related services (collectively, the "Services"), you ("you," "your," or "User") agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use the Services.

2. Eligibility & Account Registration

  1. Minimum Age. You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Services.
  2. Account. Some features require creating an account through our authentication provider, Clerk. You agree to provide accurate information, keep credentials confidential, and promptly update any changes.
  3. Responsibility. You are solely responsible for all activity under your account. Notify us immediately at eric@blessedlabs.xyz of any unauthorized use.

3. Service Description

Powwow Pin is an informational platform that:

  • aggregates and publishes Native cultural event listings ("Powwows") and related media;
  • offers interactive maps (powered by Mapbox) and optional location-based search;
  • provides an AI-driven chat assistant (via Microsoft Azure OpenAI) to answer cultural or logistical questions; and
  • hosts content such as text, images, and links submitted by Blessed Labs staff or community contributors.

No Professional Advice. Information on the Services is for general informational and cultural-educational purposes only and does not constitute legal, medical, or professional advice.

4. User Content & Conduct

  1. User Content. "User Content" means any text, images, or other material you upload, post, or otherwise transmit via the Services.
  2. License to Blessed Labs. By submitting User Content, you grant Blessed Labs a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute that content solely to operate, improve, and promote the Services.
  3. Acceptable Use. You agree not to:
    • violate any applicable law or regulation;
    • infringe or misappropriate intellectual-property, privacy, or publicity rights;
    • upload unlawful, harassing, hateful, or otherwise objectionable content;
    • access or use the Services to build a competing product or scrape large-scale data without permission;
    • attempt to interfere with, harm, reverse-engineer, or hack the Services or third-party providers we rely on (Clerk, Mapbox, Azure, Vercel, etc.).
  4. Removal. We may remove or disable content and/or suspend accounts that violate these Terms or applicable law.

5. Intellectual Property

  1. Our IP. The Services, including all software, designs, text, graphics, trademarks, and content provided by Blessed Labs (excluding User Content), are owned by or licensed to Blessed Labs and protected by intellectual-property laws.
  2. Limited License. Subject to these Terms, Blessed Labs grants you a limited, non-exclusive, revocable license to access and use the Services for personal, non-commercial purposes.

6. Third-Party Services & Links

The Services integrate or link to third-party platforms (e.g., Mapbox maps, Azure OpenAI, external event sites). We do not control or endorse third-party content and are not responsible for losses arising from your use of such sites or services. Your use is governed by each third party's own terms and policies.

7. Location-Based Features

If you enable location permissions, we will collect and process your device's precise location to display nearby Powwows. You can revoke permission at any time in your browser or device settings. Accuracy of location-based results is not guaranteed.

8. AI-Generated Content

Our chat assistant generates responses using large language models. AI output is automatically generated, may be incomplete or inaccurate, and should be independently verified before relying on it. You understand and accept the risk of using AI-generated information.

9. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for conduct that we reasonably believe violates these Terms or is harmful to other users, Blessed Labs, or third parties. Upon termination, Sections 4–13 survive.

10. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." BLESSED LABS MAKES NO WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT GUARANTEE THE AVAILABILITY, RELIABILITY, OR SECURITY OF THE SERVICES OR ANY CONTENT THEREIN.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BLESSED LABS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, OR SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY UNDER THESE TERMS SHALL NOT EXCEED USD $100 OR THE AMOUNT YOU PAID US (IF ANY) IN THE SIX MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.

12. Indemnification

You agree to defend, indemnify, and hold harmless Blessed Labs, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your use of the Services; (b) your User Content; or (c) your violation of these Terms.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law principles. Any dispute arising out of or relating to the Services shall be resolved exclusively in the state or federal courts located in Los Angeles County, California, and you consent to personal jurisdiction in those courts.

14. Modifications

We may update these Terms at any time. We will post the revised Terms with an updated "Effective Date," and your continued use after the Effective Date constitutes acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Services.

15. Miscellaneous

  • Entire Agreement. These Terms and the Privacy Policy are the entire agreement between you and Blessed Labs regarding the Services.
  • Severability. If any provision is held invalid or unenforceable, the remaining provisions remain in full force.
  • Waiver. Blessed Labs' failure to enforce any right or provision is not a waiver of future enforcement.
